Only if he's listed on the books somewhere as human (e.g. has a birth certificate or other official document acknowledging his existence, such as the paperwork you filed when marrying in the first place and divorcing in the second). The laws don't distinguish between types of relationships, they just say we can't kill anyone without suffering the consequences of much paperwork, and a potential trial followed by the possibility of time off of work residing full time in a fully catered facility, which doesn't come with important things like 24/7 internet access.
